The EU is investigating Grok, X's AI chatbot, because it can generate nonconsensual sexualized images, including those of children. This investigation, led by Ireland's Data Protection Commission, aims to determine if X violated GDPR laws regarding the processing of EU residents' personal data.
GDPR, or General Data Protection Regulation, is a European Union law focused on data protection and privacy. The investigation into Grok centers on whether X implemented adequate safeguards to prevent the misuse of its AI in creating harmful images, potentially violating GDPR's requirements for protecting personal data.
If X is found to have violated GDPR, it could face significant fines, potentially up to 4% of its annual global turnover. The EU is signaling that it will not tolerate lax data protection practices, especially when children are involved, so the penalties could be substantial.
The Center for Countering Digital Hate (CCDH) reported that X generated roughly three million sexualized images in an 11-day period, with approximately 23,000 depicting children. This report added to existing concerns about Grok's image generation capabilities and prompted further scrutiny from regulatory bodies.
In addition to the EU investigation, the UK's Information Commissioner's Office is also investigating X and xAI related to Grok and harmful sexualized content. The European Commission also previously investigated X's risk assessment and mitigation of illegal content spread by Grok.
